IMPORTANT NOTICE TO MARYLAND RESIDENTS: Your personal information is protected under the Maryland Online Data Privacy Act (MODPA). For a full description of your rights, see Section 7 (Consumer Privacy Rights — Maryland) below.

IMPORTANT NOTICE TO CALIFORNIA RESIDENTS: Your personal information is protected under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). For a full description of your rights, see Section 8 (Consumer Privacy Rights — California) below.

WE DO NOT SELL YOUR PERSONAL INFORMATION. We do not share your personal information with third parties for cross-context behavioral advertising or targeted advertising without providing the required opt-out mechanisms. See Section 5.F and the Advertising, Cookies & Analytics Notice for full disclosures.

This Privacy Policy describes how Whisker Labs, Inc. d/b/a Ting Labs (“Ting Labs,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information in connection with the Ting Fire Safety Service (“TFSS”) and the Ting mobile application. It applies to subscribers who use the TFSS, whether enrolled through an insurance partner program or directly through Ting Labs.

Advertising, cookie, and third-party analytics disclosures are addressed in the separate Ting Fire Safety Service Advertising, Cookies & Analytics Notice (“Advertising Notice”), which follows this Privacy Policy.

1.  Communications With You

A.  Service Communications

In providing the TFSS, we may contact you by email, SMS message, voice phone call, in-app message, or other methods to: notify you of electrical hazard detections or Fault events; provide installation, remediation, or service-related information; deliver safety alerts requiring your action; and communicate important service or account updates. Service communications are an integral component of the TFSS and are sent on a transactional basis consistent with your enrollment.

B.  Marketing Communications

We do not market other companies’ products, services, or promotions to you. If, at a future time, we determine there would be value in sharing information about other products or services, we will first provide you notice and seek your express written opt-in consent before sending any such communications.

C.  SMS / Text Message Communications

If you have provided your mobile telephone number and consented to SMS communications, we may send service-related text messages. Message and data rates may apply. You may opt out of SMS communications at any time by replying STOP. For help, reply HELP or contact us at 1-877-793-2203. Promotional SMS campaigns, if any, require separate express written consent under the TCPA and are subject to the disclosures provided at the point of consent.

D.  AI-Assisted Voice Communications

If you have provided express written consent, we may use AI-assisted voice technology to contact you regarding TFSS service activation reminders, sensor status alerts, or remediation follow-ups. You may withdraw consent for AI-assisted voice calls at any time by contacting us at 1-877-793-2203 or help@tinglabs.com. AI-assisted voice communications are governed by the FCC’s 2024 rules on AI-generated calls under the TCPA.

2.  Information We Collect

A.  Account and Registration Information

We may collect information such as:

  • name;
  • email address;
  • telephone number;
  • mailing address;
  • installation address;
  • account credentials;
  • payment or billing-related information;
  • customer-service communications;
  • and Partner-program enrollment information.

B.  Ting Sensor and Operational Data

The Ting sensor measures electrical and electromagnetic characteristics associated with residential electrical systems and utility-connected infrastructure.

Depending on the configuration of the Service, we may collect:

  • electrical measurements and telemetry;
  • electrical Fault information;
  • micro-arc and spark signatures;
  • voltage conditions;
  • outage-related information;
  • operational alert information;
  • utility-side electrical conditions;
  • environmental and operational event information;
  • remediation-related information;
  • and operational analytical information associated with electrical safety, utility remediation, resilience, wildfire prevention, or infrastructure analysis.

This information may include geographically associated operational telemetry tied to the fixed installation location of the Ting sensor.

C.  Installation Location Information

The Ting sensor is designed to operate at a fixed installation location associated with a residential electrical system and utility service area.

We may collect:

  • installation address information;
  • fixed installation-location information;
  • utility service-area information;
  • and GPS-assisted installation verification information.

During installation or activation, the Ting mobile application may temporarily access mobile-device location services for the purpose of confirming the installation location, validating the proper installation address, associating the Ting sensor with the correct utility service area, and supporting proper operation of the Service.

The TFSS does not use mobile-device location services for:

  • continuous movement tracking;
  • geofencing;
  • occupant monitoring;
  • behavioral location profiling;
  • or cross-context behavioral advertising.

Operational installation-location information is used as part of the fixed-location operation of the Service and associated infrastructure-analysis, safety, resilience, and remediation functions.

D.  Website and Application Usage Data

When you visit our website tingfire.com or use the Ting mobile application, we and our service providers may automatically collect device information, browser type, IP address, operating system, referring URLs, pages visited, and application interaction data. This information is used for service operation, analytics, and advertising measurement purposes as described in the Advertising Notice.

E.  Information from Third Parties

We may receive information from insurance partners who sponsor your TFSS enrollment, including enrollment confirmation, program identification, and program-related communications. We may also receive technical information from device manufacturers, utility partners in connection with service delivery, and analytics or attribution providers in connection with advertising measurement.

F.  Error Monitoring and Diagnostics Data

To operate the TFSS and the Ting mobile application reliably, we and our error-monitoring service provider collect application error and crash diagnostics — including error messages, stack traces, app and operating system version, device model, and the sequence of app activity preceding an error — when the Ting mobile application encounters a fault. Before you accept the applicable End User License Agreement, these diagnostics are collected on an anonymized basis and are not associated with your account or device, and your IP address is not stored. After you accept the applicable End User License Agreement, diagnostic records may be associated with your account identifier and, if you have activated a Ting Sensor, the Sensor’s device serial number, so that we can trace and resolve issues affecting your account or device specifically. We attach only the minimum identifiers reasonably necessary for this purpose. We apply automated redaction that removes secrets and personal information from diagnostic payloads, including from stack traces, and we do not collect the contents of app requests or responses, cookies, or precise geolocation as part of this diagnostics data. This data is used solely to detect, diagnose, and resolve application errors and to maintain Service reliability, and is not used for advertising, profiling, or marketing.

3.  How We Use the Information We Collect

We use information we collect to:

  • deliver, operate, and support the TFSS, including sensor monitoring, Fault detection, safety alerts, and remediation coordination;
  • verify installation location and associate the Ting sensor with the correct utility service area;
  • analyze electrical and infrastructure data to detect faults, assess grid conditions, and support utility coordination;
  • communicate with you about your service, account, and safety events;
  • process payments and manage your account;
  • comply with applicable legal obligations, court orders, or governmental requests;
  • improve and develop the TFSS and related products and services;
  • support insurance partner program administration, to the extent you are enrolled through a Partner;
  • measure and attribute advertising campaigns, as described in the Advertising Notice;
  • detect, diagnose, and resolve application errors and maintain the reliability of the Ting mobile application;
  • and fulfill other purposes disclosed at the time of collection or with your consent.

4.  Operational Data and Infrastructure Analysis

A.  Operationally Necessary Functions

The collection and use of geographically associated Sensor Data, Installation Location Information, and related operational telemetry is an integral and operationally necessary component of delivering the TFSS. Without this information, Ting Labs cannot detect electrical faults, identify infrastructure anomalies, coordinate utility-side remediation, or fulfill the community-safety mission of the Service as described in the TFSS Terms of Service.

This language is aligned with Section 3 of the TFSS Terms of Service and is intended to support the operationally necessary and strictly necessary characterization under MODPA and CCPA/CPRA respectively.

B.  Grid Fault Analysis and External Notification

As a component of the TFSS, Ting Labs analyzes Sensor Data from multiple sensors to identify electrical fault patterns that may indicate infrastructure-level issues affecting the utility grid or broader electrical infrastructure. When analysis indicates a potential grid fault, Ting Labs may notify utility companies, grid operators, or relevant governmental authorities as part of the TFSS’s community-safety and infrastructure-resilience functions.

External notification to utilities and governmental authorities is a fundamental component of the TFSS service architecture and is an operationally necessary use of Sensor Data. Ting Labs applies geographic minimization principles: operational telemetry is shared at the infrastructure or service-area level by default, and address-level information is disclosed only where strictly necessary for remediation or safety purposes.

C.  No Separate Opt-Out for Operationally Necessary Sharing

Because geographically associated Sensor Data sharing with utilities, grid operators, and government authorities is an integral and operationally necessary component of the TFSS as described in Section 4.A, Ting Labs does not offer a separate opt-out from this sharing.

5.  How We Share Your Information

A.  Service Providers

We share personal information with service providers who perform functions on our behalf, including cloud hosting, payment processing, customer support, analytics, error monitoring and diagnostics, email delivery, SMS delivery, and advertising measurement. Service providers are contractually prohibited from using personal information for their own purposes and are required to protect it in a manner consistent with this Privacy Policy.

B.  Insurance Partners

If you enrolled in the TFSS through an insurance partner program, we share information with your insurance partner as needed to administer the program, including:

  • enrollment confirmation and program identification;
  • installation confirmation;
  • service status information relevant to the partner program;
  • and Fault event notifications relevant to the partner program, where applicable.

For information about what your specific insurance partner receives, you may contact Ting Labs at privacy@tinglabs.com. See Section 6.C regarding the effect of account deletion on your enrollment in a partner program and on the TFSS generally.

C.  Utility Companies and Grid Operators

As described in Section 4, Ting Labs shares geographically associated operational telemetry with utility companies, grid operators, and relevant governmental authorities as an operationally necessary component of the TFSS. This sharing is conducted at the infrastructure or service-area level by default. Address-level information is disclosed only where strictly necessary for remediation or safety purposes.

D.  Governmental Authorities and Legal Process

We may disclose personal information to governmental authorities, law enforcement, or other parties when required by applicable law, court order, or legal process; when necessary to protect the safety of any person; or when necessary to protect the rights and property of Ting Labs.

E.  Business Transfers

In the event of a merger, acquisition, reorganization, asset sale, or similar transaction, personal information may be transferred as part of the transaction. We will provide notice of any such transfer and the choices available to subscribers as required by applicable law.

F.  No Sale; Advertising Sharing Disclosures

Ting Labs does not sell personal information to third parties. Ting Labs does not share personal information for cross-context behavioral advertising without providing the opt-out mechanisms required by applicable law. Sharing of personal information in connection with advertising technologies (including conversion measurement with Meta and Google) is disclosed in the Advertising, Cookies & Analytics Notice and is subject to applicable opt-out mechanisms described therein.

6.  Managing Your Information and Privacy Choices

A.  Account Information

You may access and update your account information (name, email, address, telephone number) through the Ting mobile application or by contacting us at privacy@tinglabs.com or 1-877-793-2203. You have the right to request correction of inaccurate personal information we hold about you.

B.  Communications Preferences

You may manage email marketing preferences through the unsubscribe link in any marketing email. You may manage SMS preferences by replying STOP to any SMS message. Service communications (safety alerts, remediation notices, and account communications) are transactional and are not subject to marketing opt-out.

C.  Account Deletion

You may request deletion of your Ting account and associated personal information through the Delete Account portal at https://my.datasubject.com/3tWAT6O3PN/65621 or by contacting us at privacy@tinglabs.com. We will respond to deletion requests within 45 days (30 days for Canadian users under PIPEDA). We may retain certain information as required by law, for fraud prevention, to resolve disputes, or to fulfill contractual obligations.

Because Ting Labs must be able to contact you to detect and respond to a Fault or other hazard, deleting your account will result in cancellation of your TFSS subscription. Once your account is deleted, you will no longer receive Fault detection, remediation coordination, or emergency notification services.

D.  Response Timelines

We will respond to verifiable consumer requests within 45 days of receipt (or, for requests from Canadian users under PIPEDA, 30 days, extendable by an additional 30 days with notice). If we require additional time (up to 45 additional days), we will notify you in writing of the reason and the extension period. We will not charge a fee for processing your request unless it is excessive, repetitive, or manifestly unfounded.

7.  Consumer Privacy Rights — Maryland Residents (MODPA)

Maryland residents have the following rights under the Maryland Online Data Privacy Act (MODPA), effective October 1, 2025:

A.  Right to Access

You have the right to confirm whether Ting Labs processes your personal data and to access that data.

B.  Right to Correction

You have the right to correct inaccurate personal data we maintain about you.

C.  Right to Deletion

You have the right to request deletion of personal data you have provided to us or that we have collected about you, subject to applicable exceptions.

D.  Right to Data Portability

You have the right to obtain a copy of your personal data in a portable and readily usable format.

E.  Right to Opt Out of Targeted Advertising

You have the right to opt out of the processing of your personal data for purposes of targeted advertising. Ting Labs’ targeted advertising practices are described in the Advertising, Cookies & Analytics Notice. To opt out, use the “Do Not Sell or Share My Personal Information” mechanism available on our website footer or contact us at privacy@tinglabs.com.

F.  Right to Opt Out of Profiling

You have the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects. Ting Labs does not engage in profiling for such purposes.

G.  Right to Opt Out of Sale

Ting Labs does not sell personal data as defined under MODPA.

H.  Right to Consent Revocation for Sensitive Data

Where Ting Labs processes sensitive personal data based on your consent, you have the right to revoke that consent. Revocation will be honored within 30 days. Revocation does not affect the lawfulness of processing prior to revocation.

I.  Global Privacy Control

Ting Labs honors Global Privacy Control (GPC) and Universal Opt-Out Mechanism (UOOM) signals as opt-out signals for targeted advertising and sale of personal data for Maryland residents.

J.  Non-Discrimination

Ting Labs will not discriminate against you for exercising your MODPA rights.

K.  How to Submit a Request

Maryland residents may submit privacy rights requests through the privacy rights portal at https://my.datasubject.com/3tWAT6O3PN/65621 or by contacting privacy@tinglabs.com. Ting Labs will verify your identity before processing requests and will respond within 45 days.

L.  Right to Appeal

If Ting Labs declines to take action on your request, you may appeal by submitting a written appeal to privacy@tinglabs.com within 30 days of receiving our decision. We will respond to appeals within 60 days. If your appeal is denied, you may contact the Maryland Attorney General.

8.  Consumer Privacy Rights — California Residents (CCPA/CPRA)

California residents have the following rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA):

A.  Right to Know

You have the right to request that Ting Labs disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purposes for collection, and the categories of third parties with whom we share your information.

B.  Right to Delete

You have the right to request deletion of personal information we have collected about you, subject to applicable exceptions (e.g., to complete transactions, detect security incidents, comply with legal obligations, or enable solely internal uses consistent with your relationship with us).

C.  Right to Correct

You have the right to request correction of inaccurate personal information.

D.  Right to Opt Out of Sale or Sharing

You have the right to opt out of the sale of your personal information and the sharing of your personal information for cross-context behavioral advertising. Ting Labs does not sell personal information. Sharing for advertising purposes is disclosed in the Advertising Notice and is subject to opt-out mechanisms provided therein.

E.  Right to Limit Use of Sensitive Personal Information

You have the right to limit Ting Labs’ use of your sensitive personal information (including precise geolocation and payment information) to uses that are reasonably necessary to perform the Service. Ting Labs uses sensitive personal information only as necessary to deliver and operate the TFSS.

F.  Right to Data Portability

You have the right to receive a copy of your personal information in a portable and readily usable format.

G.  Right to Non-Discrimination

Ting Labs will not discriminate against you for exercising your CCPA/CPRA rights.

H.  Authorized Agents

You may designate an authorized agent to submit requests on your behalf. We may require proof of authorization and verification of your identity.

I.  How to Submit a Request

California residents may submit requests through the privacy rights portal at https://my.datasubject.com/3tWAT6O3PN/65621, by emailing privacy@tinglabs.com, or by calling 1-877-793-2203. We will respond within 45 days.

9.  Other State Privacy Rights

Residents of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Texas (TDPSA), and Oregon (OCPA) have privacy rights under their respective state laws that may include rights to access, correction, deletion, portability, and opt-out of targeted advertising and sale. 10.  Data Retention

Ting Labs retains personal information for as long as necessary to deliver the TFSS, fulfill the purposes described in this Privacy Policy, and comply with applicable legal obligations. Retention periods vary by data category:

  • Account Information: for the duration of the active subscription and for a reasonable period thereafter as necessary for legal, compliance, or operational purposes.;
  • Sensor and Operational Data: for three (3) years following collection, or longer if required for infrastructure safety or regulatory purposes;
  • Payment Information: retained by payment processors subject to PCI-DSS requirements;
  • Communications Records: for three (3) years following the communication.
  • Diagnostics Data: retained by our error-monitoring service provider for 90 days following collection.

11.  Data Security

Ting Labs maintains technical and organizational measures designed to protect personal information against unauthorized access, disclosure, alteration, or destruction. These measures include encryption in transit and at rest, access controls, and regular security assessments. No data transmission or storage system can be guaranteed to be 100% secure. If you believe your account or personal information has been compromised, please contact us immediately at help@tinglabs.com or 1-877-793-2203.

12.  Children’s Privacy

The TFSS is not directed to individuals under the age of 18. Ting Labs does not knowingly collect personal information from anyone under 18. If we learn that we have inadvertently collected personal information from a person under 18, we will delete it promptly. If you believe we have collected information from a minor, please contact us at privacy@tinglabs.com.

13.  Canadian Users

Canadian users’ personal information may be transferred to, stored in, or processed in the United States. By using the TFSS, Canadian users acknowledge that their personal information may be subject to applicable U.S. law, including lawful access by U.S. government authorities.

Canadian users may contact Ting Labs at privacy@tinglabs.com regarding questions about this Privacy Policy, to access or correct their personal information, or to submit a privacy-related complaint.

Note that the binding arbitration provisions of the TFSS Terms of Service do not apply to Canadian users. Disputes involving Canadian users are subject to the jurisdiction of the applicable Canadian courts as set forth in the Terms of Service.

14.  Changes to This Privacy Policy

Ting Labs may update this Privacy Policy from time to time. If material changes are made — including changes to sensitive data practices, data-sharing categories, or consumer rights — Ting Labs will provide notice through the Service, website, email, or other appropriate means, and will seek affirmative consent where required by applicable law. Continued use of the TFSS following notice of non-material changes constitutes acknowledgment of the updated Privacy Policy. Please review this Privacy Policy periodically.

This Advertising, Cookies & Analytics Notice (“Advertising Notice”) describes Ting Labs’ use of cookies, tracking technologies, analytics tools, and advertising platforms in connection with its website tingfire.com and the Ting mobile application. It is a companion document to the Ting Labs Privacy Policy. Capitalized terms not defined here have the meanings given in the Privacy Policy.

This Notice is provided separately from the main Privacy Policy to maintain a clear separation between Ting Labs’ operational TFSS data practices and its website/app advertising practices, consistent with applicable law and Ting Labs’ representations that advertising practices are not applied to TFSS operational data.

1.  Scope and Applicability

This Advertising Notice applies to:

  • visitors to tingfire.com;
  • users of the Ting mobile application;
  • and individuals who interact with Ting Labs’ digital advertising campaigns.

This Advertising Notice does not apply to operational TFSS data collected by the Ting sensor, which is governed exclusively by the Privacy Policy.

2.  Cookies and Tracking Technologies

Ting Labs and its service providers may use cookies, SDKs, pixels, tags, local storage, device identifiers, and related technologies to support website functionality, analytics, attribution, ecommerce operations, advertising measurement, fraud prevention, and marketing effectiveness analysis.

Cookies may be:

  • session-based (expiring when you close your browser);
  • persistent (remaining on your device for a set period);
  • first-party (set by Ting Labs); or
  • third-party (set by our analytics and advertising service providers).

We do not deploy advertising tracking technologies prior to obtaining applicable consent where required by law. Advertising tags do not fire prior to consent on applicable platforms.

3.  Analytics and Attribution Technologies

Ting Labs uses analytics and attribution technologies to understand website and application usage, measure advertising effectiveness, attribute app installations and conversions, improve user experience, and evaluate marketing performance.

Currently active analytics and attribution technologies include:

  • Google Analytics — for website usage analysis and performance measurement;
  • AppsFlyer — for mobile app attribution and conversion measurement.
  • Google Enhanced Conversions — for improved conversion measurement accuracy using hashed customer information (e.g., email address) matched against Google account data.

These technologies may collect device identifiers, browser information, IP address, application interaction information, advertising attribution information, and related analytics information.

4.  Advertising Technologies and Platform Relationships

Ting Labs uses advertising and conversion technologies to support conversion measurement, advertising attribution, audience suppression, campaign optimization, and related advertising functions.

Currently active advertising technologies include:

  • Meta Conversions API (CAPI) — for conversion measurement and advertising attribution in connection with Meta advertising campaigns;
  • Google Ads conversion tracking — for conversion measurement and advertising attribution in connection with Google advertising campaigns.
  • Meta pixel-based behavioral targeting — for building and reaching audiences based on website and application activity;
  • Suppression list uploads — hashed customer contact information (e.g., email address) provided to Meta and Google to exclude existing subscribers from certain advertising audiences.

These providers operate as service providers or data processors on behalf of Ting Labs for purposes of conversion measurement and campaign optimization. Meta pixel-based behavioral targeting and suppression list uploads are not limited to service-provider processing on behalf of Ting Labs; they constitute “sharing” for cross-context behavioral advertising under CCPA/CPRA and “targeted advertising” under MODPA, VCDPA, CPA, CTDPA, TDPSA, and OCPA, and are subject to the opt-out mechanisms described in Section 5.

5.  Targeted Advertising and Required Opt-Out Mechanisms

To the extent Ting Labs’ advertising practices constitute “targeted advertising” or “sharing” under applicable state privacy laws (including MODPA, CCPA/CPRA, VCDPA, CPA, CTDPA, TDPSA, and OCPA), Ting Labs provides the following opt-out mechanisms:

6.  Separation of Operational and Advertising Data

Ting Labs maintains a strict operational separation between TFSS sensor data and advertising technology platforms. Ting sensor data, Installation Location Information, Fault information, and related operational telemetry are not shared with Meta, Google, or any advertising technology platform, and are not used for advertising targeting, audience creation, or campaign optimization.

Advertising technologies described in this Notice operate exclusively in connection with website and application usage data — not TFSS operational data.
